NOTICE OF SALE UNDER POWER GEORGIA, STEPHENS COUNTY By virtue of the power of sale contained in a Security Deed from Amber Felder to Mortgage Electronic Registration Systems Inc., as nominee for Homestar Financial Corp., its successors and assigns dated June 14, 2012 recorded in Deed Book 985, Page 90-101 , Stephens County Records, and last assigned to JPMorgan Chase Bank, National Association, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED TWENTY-TWO THOUSAND FOUR HUNDRED FORTY-EIGHT AND 00/100 ($122,448.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Stephens County, Georgia, during the legal hours of sale on the first Tuesday, August 5, 2014 the following described property, to wit: All that tract or parcel of land, with improvements thereon, lying and being in the Toccoa (440th) G.M.D., Stephens County, Georgia, and being known and designated as LOT 30 AND THE SOUTH HALF OF LOT 31, FOXDALE SUBDIVISION, and being more particularly described as follows: BEGINNING at an iron pin corner at the Northeast intersection of the right-of-way of Foxdale Drive with Beaverbrook Drive at the Southwest corner of Lot 30; thence running along the right-of-way of Foxdale Drive North 07 degrees 45 minutes East 130.0 feet to an iron pin corner common to Lots 30 and 31; thence continuing along the right-of-way of Foxdale Drive North 07 degrees 45 minutes East 65 feet to a point; thence running South 82 degrees 51 minutes East to the centerline of a branch; thence following the centerline of a branch in a Southern direction 225 feet, more or less, to the intersection of the branch with the North right-of-way of Beaverbrook Drive; thence running from the centerline of said branch along the North right-of-way of Beaverbrook Drive North 74 degrees 50 minutes West 203.7 feet to the iron pin point of beginning. Said tracts being more particularly described in a Plat of Survey of Foxdale Subdivision as prepared by Clelland A. Tyson, Georgia Registered Land Surveyor, dated March 6, 1979, revised November 29, 1979, and June 30, 1980, the description as contained therein being incorporated herein by reference. This is the same property conveyed by Warranty Deed (For Life With Remainder to Survivor) from John E. Novack to John E. Novack and Sara Jean Novack dated October 22, 1988, and recorded in Deed Book 217, Page 702, Stephens County Records. John Edward Novack passed away on April 24, 1992. This conveyance is made subject to Restrictive Covenants dated October 31, 1979, and recorded in Deed Book 154, Pages 66-67, Stephens County Records. The Debt secured by said Security Deed has been and is hereby declared due because of nonpayment of the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorneys fees, notice of intent to collect attorneys fees having been given. Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Amber Felder or, a tenant or tenants, and said property was or is commonly known as 17 Beaver Brook Drive Toccoa, GA 30577. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
