NOTICE OF SALE UNDER
Pursuant to the power of sale contained in the Security Deed executed by JUNE P. MERCER to REGIONS MORTGAGE, INC. in the original principal amount of $42,745.00 dated September 23, 2002 and recorded in Deed Book 569, Page 312, Stephens County records, said Security Deed being last transferred to NEWREZ LLC DBA SHELLPOINT MORTGAGE SERVICING, Stephens County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on March 02, 2021, the property in said Security Deed and described as follows:
ALL THAT TRACT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, LYING AND BEING IN THE 440TH G.M. DISTRICT OF STEPHENS COUNTY, GEORGIA, AND LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF TOCCOA, GEORGIA, AND BEING LOCATED BETWEEN TOCCOA STREET AND PINE STREET, FRONTING 65 FEET ON TOCCOA STREET AND 55 FEET ON PINE STREET AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EAST RIGHT OF WAY OF TOCCOA STREET, SAID POINT BEING COMMON TO THE PROPERTY HEREIN CONVEYED, THE EAST RIGHT OF WAY OF TOCCOA STREET AND PROPERTY NOW OR FORMERLY OF ROBINSON AND BEING LOCATED 150 FEET, MORE OR LESS, NORTH OF THE INTERSECTION OF EAST RIGHT OF WAY OF TOCCOA STREET AND WEST RIGHT OF WAY OF PINE STREET; THENCE IN A GENERAL NORTHEASTERLY DIRECTION ALONG THE EAST RIGHT OF WAY OF TOCCOA STREET 65 FEET TO A POINT NEXT TO PROPERTY OF W. J. ROTHELL AND COMPANY; THENCE IN A GENERAL EASTERLY DIRECTION ALONG WITH PROPERTY OF W. J. ROTHELL AND COMPANY AND PAYNE 84 FEET TO A POINT; THENCE CONTINUING ALONG THE LINE OF PROPERTY OF PAYNE PROPERTY IN A SOUTHEASTERLY DIRECTION 93 FEET TO A POINT ON THE WEST RIGHT OF WAY OF PINE STREET; THENCE SOUTH ALONG THE WEST RIGHT OF WAY OF PINE STREET 55 FEET TO A POINT COMMON TO THE PROPERTY HEREIN DESCRIBED, PROPERTY OF ROBINSON AND THE WEST RIGHT OF WAY OF PINE STREET; THENCE IN A WESTERLY DIRECTION ALONG PROPERTY OF ROBINSON 115 FEET TO THE BEGINNING POINT AND BEING THE SAME PROPERTY CONVEYED BY CLAUDE EDMONDS TO MRS. CLAUDE EDMONDS (MRS. ESSIE) AND BILLY EDMONDS BY WARRANTY DEED, DATED FEBRUARY 24, 1961 AND ALSO BEING THE PROPERTY CONVEYED BY ANDREW DOVER AND CLARA E. DOVER TO CLAUDE EDMONDS BY WARRANTY DEED, DATED FEBRUARY 16, 1959 AND RECORDED IN THE DEED RECORDS OF STEPHENS COUNTY, GEORGIA.
Said property being known as: 163 TOCCOA ST, TOCCOA, GA 30577
To the best of the undersigneds knowledge, the party or parties in possession of said property is/are JUNE P. MERCER or tenant(s).
The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
